Seaman Files Jones Act Lawsuit After Injuring Back

A Seaman has filed a Jones Act lawsuit against his employer after he allegedly injured his back while moving underwater jacks. The diver, Robert Forrest, filed the suit against Global Industries Offshore in federal court in New Orleans in September 2010.

According to the suit, Forrest was working as a seaman and a commercial diver onboard the vessel Titan 2 when the incident occurred. He claims that he suffered a severe neck injury while moving underwater jacks in January 2008.

The Titan 2 is owned by the defendant, Global Industries Offshore. They have been accused of negligence for failing to properly plan the dive and to reduce the inherent risk of the dive. The suit also alleges that Global Industries Offshore failed to properly man, equip, maintain and operate the vessel.

Global Industries Offshore allegedly failed to establish and implement a Job Safety Analysis to identify and address the inherent hazards concerning Forrest’s dive.

In the suit, Forrest is seeking damages for emotional trauma and distress, disfigurement and impairment, , loss of wages, loss of future life pleasures, fringe benefits, earning capacity, medical expenses and court costs associated with the case.

The Jones Act lawsuit has been assigned to U.S. District Judge Ivan L.R. Lemelle. It is Case No. 2:10cv02955.
