Permanent Back Injury Prompts Louisiana Seaman to Sue Employer

When a Louisiana seaman permanently injured his back while loading groceries onto the vessel on which he was employed, he took action. Citing a lack of proper equipment as well as inadequate manpower, he filed suit in New Orleans federal court on December 3, 2011.

Henry William Gamp, chief mate and crewmember of the tug barge Lucia/Carribean, is suing his employer, Penn Maritime Inc. and his employer’s insurance company.

The tug barge was located on the Mississippi River in St. Charles Parish. Gamp was reportedly ordered to leave the barge in order to go shopping for groceries and other needed supplies. While Gamp unloaded the groceries, he suffered a back injury that required surgery and was ultimately disabling.

He claims the defendants were negligent and is asking for damages including loss of wages, diminished earning capacity, medical costs, court costs and loss of enjoyment of life.
