An accident involving a barge has resulted in a Jones Act lawsuit filed by an injured maritime worker filing against his employer. The suit was filed against R.L. Eldridge Construction by Groves resident Charles Landry in Jefferson County District Court on May 5, 2011.
According to Mr. Landry's petition, he sustained an injury on May 5, 2009, while working for R.L. Eldridge Construction. His alleged injuries occurred while he was hooking a cable to a barge. There were no other details concerning the extent of his injuries or how the accident occurred.
Mr. Landry is accusing his former employer, R.L. Eldridge Construction, of negligently failing to provide a safe work environment. He also claims that the barge was in unseaworthy conditions at the time of the accident.
"Plaintiff felt immediate pain after the incident," the Jones Act suit claims. "The severe and permanent injuries suffered by plaintiff were negligently caused by defendant."
The plaintiff is seeking damages that include his alleged past and future medical expenses, pain, impairment, mental anguish, and disfigurement. He is also seeking lost wages and all court costs associated with his case.
Mr. Landry's Jones Act case has been assigned to 58th District Court Judge Bob Wortham.
