A barge worker has filed a lawsuit against his employer following a maritime accident that left him with an amputated right leg. Gary Levis filed his job injury suit against Bluegrass Marine and Marquette Transportation Company in Kanawha Circuit Court on February 9, 2011.
According to the suit, Mr. Levis suffered a maritime injury on September 14, 2009, while working onboard the M/V Titletown USA. The M/V Titletown USA was towing seven loaded barges when the incident reportedly occurred.
Mr. Levis claims that he was working as the lead deckhand on the front watch when the tow became grounded. This caused one of the barges to break loose from the tow. That is when Mr. Levis says that he was instructed to catch the barge and tie it off to the side of the tow. However, when the master caused the tow to move suddenly, a line tightened unexpectedly and sprang into Mr. Levis’ right leg.
According to Mr. Levis, the line traumatically tore off his lower leg. Doctors were required to amputate his lower right leg as a result of the accident. Mr. Levis also claims that the master’s negligence contributed to the accident and ultimately, his injury.
The injured seaman is seeking compensatory damages with pre-judgment and post-judgment interest.
