On December 3, 2011, Henry William Gamp filed a lawsuit in New Orleans against his employer, Penn Maritime Inc. Mr. Gamp also filed a complaint against ABC Insurance Co. Mr. Gamp asserts that he was injured while working as a chief mate aboard one of the ships owned by Penn Maritime Inc. He alleges that his injury was a direct result of the company’s negligence.
The incident which gave rise to Mr. Gamp’s December claim occurred on April 13, 2011 while the ship was in the waters of the Mississippi River in St. Charles Parish. On that day, Mr. Gamp was the chief mate and crewmember of the articulated tug barge Lucia/Caribbean. Mr. Gamp alleges that he was told to leave the boat and purchase groceries and supplies from LaPlace. He was also instructed to load the supplies onto the ship.
While carrying out this order, Mr. Gamp injured his back and has become permanently disabled.
He therefore alleges that the defendant, his former employer, acted negligently by failing to provide sufficient equipment and manpower to allow employees to work safely. He is seeking an award of damages, including for the following:
