A May 23 trial date has been set for the Daphne, Alabama city clerk charged with boating under the influence (BUI) of alcohol.
43-year-old David Cohen of Fairhope was arrested after running his boat aground while operating at a high rate of speed on the Apalachee River, said Alabama State Police Officer Jeremy Alford.
Neither Cohen not a male passenger were seriously hurt. Cohen failed a field sobriety test and a portable breath test, said Alford. He was booked into Baldwin County Corrections Center late that night, posted $1,000 bail and was released.
Cohen has been city clerk since 2001. He was previously charged with BUI in a 2007 incident near Orange Beach but the case was not pursued after he completed a two-year pre-trial intervention program, court records said.
Cohen has not been suspended and will remain in office at least until after the trial, said the City Council President.
He faces a possible one year jail term and a fine of up to $2,100.
