Independence Day festivities on Lake Martin were marred this year by a serious Alabama boating accident, which sent four people to Baptist South Hospital and Russell Medical Center. According to AL.com, the drivers of the two boats involved in this incident were Brittany Benton, 23, of Alexander City, and Johnny North, 45, of Birmingham. Police believe that the boats collided on the Friday evening of July 4th weekend near Sand Island. The names of the others who were injured have not been disclosed, and the incident is being investigated.
So who was negligent? How badly were the drivers and passengers hurt? How much damage was done to the boats?
The AL.com news blurb does not answer these vital questions. So it's obviously difficult to assess possible liability, even in the abstract. But you might be surprised by how quickly casual observers (and sometimes even clients) will jump to conclusions about cases, based only on flimsy evidence or speculation about an Alabama maritime accident or AL offshore injury.
Here's the reality: Even people who witness an accident firsthand and record their experiences often do not have enough objective perspective to calculate what caused the crisis or who was responsible. Surprising details can emerge during an investigation that can totally change one's perspective on issues of liability.
For instance, say a report reveals that one of the drivers (or both) had consumed alcohol on the night in question. Or maybe a police report turns up evidence that one of the boats had a malfunctioning propeller or defective engine. If a mechanical issue caused (even partially) the accident, then a whole slew of potentially liable parties might come into consideration - e.g. the manufacturer of the boat, the designer of the boat's engine, etc.
