Alabama Boating Accident Leads to BUI Arrest of Daphne City Clerk

An Alabama boating accident involving Daphne's city clerk leads to his arrest for boating under the influence (BUI). The maritime accident took place on Sunday, May 1, 2011, north of the Causeway.

According to the Alabama Marine Police, David Cohen, 43, of Fairhope, ran his boat aground north of the Causeway. He was reportedly traveling northbound at a high rate of speed on the Apalachee River toward Blakeley River. Mr. Cohen had a male passenger onboard when the incident occurred.

"He [Mr. Cohen] and his passenger are very lucky to be alive," said Alabama Marine Police Officer Jeremy Alford.

Details concerning their injuries were not immediately made known. However, their injuries were not considered to be serious. The name of Mr. Cohen's passenger was not included in the report.

Mr. Cohen, who has been Daphne's city clerk since 2001, was arrested on a charge of boating under the influence of alcohol. He was released on $1,000 bail.

"The vessel ran out of the main run of the river and landed hard up in the sawgrass," said Officer Alford.

The Alabama boating accident is still under investigation by local authorities. Officer Alfred reported that Mr. Cohen failed a field sobriety test and a portable breath test. His trial has been set for May 23, 2011.
