Your Rights as an Injured Longshoreman

Loading and unloading ship cargo can place extreme physical demands on your body. Accidents are commonplace among longshoremen and harbor workers, which can lead to serious injuries and a long recovery. If you are an injured longshoreman or stevedore, you have legal rights to compensation and medical care and depending on your situation, you may be able to sue the vessel owner for negligence.

The Longshore and Harbor Workers’ Compensation Act (LHWCA) provides benefits for employees in traditional maritime occupations, such as longshoremen, ship repairers, shipbuilders, ship breakers and harbor workers. To be eligible for LHWCA benefits, the injuries must have occurred on U.S. navigable waters, which also includes piers, docks, terminals, wharves and other areas where cargo is loaded and unloaded on vessels.

Benefits are paid for by your employer’s insurance company and you should receive your first compensation check within 14 days of the insurance carrier receiving your Notice of Injury. These benefits under the Longshore Harbor Workers’ Compensation Act include medical care and disability compensation. Medical care includes treatment relating to your injury, including any required surgery or hospitalization. It also includes medical supplies and services.

Disability compensation is designed to offset lost wages during your recovery time. There are various forms of disability as defined by the law, which include permanent total, temporary total, permanent partial or temporary partial. Generally, compensation is paid at two-thirds of your average weekly wages.

If your injury was caused by negligence from a third party other than your employer or co-workers, you may be able to file a lawsuit to recover compensation for your injuries.
