You Won't Believe the Tactics Used by Kirby Inland Marine

1. Kirby Inland Marine's Injury Protection Plan

My firm has been retained by a former employee of Kirby Inland Marine who was injured after his supervisor concealed a gasoline spill. Our client was a deckhand in training. His supervisor spilled gasoline on the deck, but decided not to report the spill, in violation of Kirby's internal operating procedures. As a result, the area where our client was working was very slippery. Our client fell and injured his back and his treating doctors have recommended back surgery to fix his medical condition. Kirby has refused to pay for his medical treatment.

During the course of the case, we have discovered some very troubling information about how Kirby protects itself after an employee injures him or herself. It's basically a series of tricks, traps, and pressure tactics not designed to help the injured employee but to protect Kirby's corporate backside. I call it "Kirby's Accident Protection Plan."

In fact, I am so troubled by what I've discovered that I thought I'd share some of Kirby's Accident Protection Plan with you, just in case you were injured working for Kirby Inland Marine or some other boat company tries the same tricks on you.

2. Kirby's Accident Protection Plan

2.1. Immediately report the incident as a minor incident when possible, and have the employee fill out a handwritten statement before he or she has a chance to think things over;

2.2 Kirby has a "light duty" house where it keeps employees who are hurt. The employees are literally padlocked into the house overnight;

2.3. Send the employees to special pre-selected medical providers (a.k.a. company doctors) rather than independent, non-biased doctors;

2.4. Kirby sends its team of lawyers to meet with the injured employee and ask them trick questions to try to get the employee to say things that would later hurt their legal case.
