Calculating Personal Injury Damages Under the Jones Act

Pain and Suffering

The Jones Act allows an injured worker to recover pain and suffering damages. While it is not possible to put a precise value on these losses, they are real, and juries typically assign a value to these damages. The more substantial and painful the injury, typically, the higher the money damages.

Disfigurement

The Jones Act allows an injured seaman to recover damages if their injury resulted in disfigurement. For instance, scars, burn injuries, amputations, or other similar marks or abuses to the body will entitle the injured seaman to damages, assessed by the jury or judge.

Mental Anguish

An injured seaman is entitled to recover damages for the anguish an injury has caused. The jury or judge decides an appropriate amount for these damages. In a serious case, these damages can be substantial. In a less serious case, the mental anguish damages are lower.
