Tugboat Accidents and the Jones Act

When a maritime worker is injured in a tugboat or towboat accident, it is not uncommon to be unable to return to work in the same capacity. Captains and crewmembers on tugs and tows have been known to suffer serious maritime injuries. The nature of the work associated with the maritime industry is dangerous.

The list of potential injuries from a tugboat accident is long and includes:

  • Traumatic brain injury or head trauma
  • Herniated disc or bulging disc
  • Spinal cord injury
  • Paralysis
  • Permanent disability
  • Burn or disfigurement
  • Death

These injuries can be the result of chemical exposure, wet surfaces, defective equipment, vessel collisions and other hazardous events. Often times, the accident and the related factors have to do with negligence of the vessel owner, crewmembers and/or operators. When a vessel owner does not provide a safe work environment or if the crew is not properly trained, the outcome can be disastrous.

If you have been injured in a tug accident or other vessel accident, you may be entitled to compensation under the Jones Act. The Jones Act is a federal law that provides legal protection for injured seamen. To recover damages under this law, you must be classified as a seaman, which is someone who is a crewmember of a vessel or has been assigned to a fleet of vessels.

The Jones Act allows you to pursue damages when negligence caused your tow accident. Compensation could include lost income, medical expenses, pain and suffering, disfigurement and mental anguish.
