We get this question a lot from workers who are injured offshore, and we have answered this question for many of the Transocean rig explosion survivors. Yours is a valid concern. You are worried that the company, or even the entire offshore industry, will black ball you if you file an injury claim. If this happens, you are worried that you will never be able to work offshore again, and this is problematic because offshore work is the only way for you to make the kind of money you were making before your injury.
Generally, if you file a legitimate injury claim, you will not be black balled by the company, nor by the offshore industry. The companies know that this is dangerous work and that their maritime employees will suffer injuries from time to time.
We are able to settle the majority of the offshore injury cases we handle, and typically this is a friendly resolution between our client, the maritime worker, and the company. We have handled hundreds of maritime injury cases, and we know all of the offshore companies and all of their lawyers. We very rarely see any of our clients get black balled after their lawsuit is resolved.
On the other hand, if you have a long history of filing numerous injury claims based on offshore injuries, then the chances that you will be black balled are increased.
So, the bottom line is this: if you have a legitimate injury claim, you should not worry about being black balled for hiring a lawyer and filing a lawsuit.
This is particularly true for victims of the Deepwater Horizon disaster. It would be quite shocking if a company tried to black ball an oil rig worker, or a worker's family, for hiring a lawyer and filing a lawsuit after a disaster as bad as this one. Certainly, nobody could legitimately claim any such lawsuit to be frivolous or harassing. We fully anticipate that after the pending and future lawsuits against the companies based on the Transocean explosion are resolved, the offshore oil rig workers who are able to continue doing offshore work will do just that, with no threat of any black balling.
