A: One of the biggest concerns we often hear from maritime workers has nothing to do with their health or pain after an accident. It has to do with how they will pay their expenses.
Under the Jones Act, seamen are entitled to compensation known as maintenance and cure, when they are hurt on the job. To receive these benefits, you do not need to prove who was at fault in the accident, which makes it similar to workers’ comp.
Cure refers to your paid medical care. Maintenance is designed to cover your living expenses. It is usually paid in an amount equivalent to $20 to $30 a day.
If your employer won’t pay maintenance and cure benefits, you should contact an experienced maritime attorney. A maritime lawyer will help you obtain these payments and will file a lawsuit on your behalf, if need be.
