Can I file a third party claim against someone other than my employer under the Longshore and Harbor Workers Compensation Act?

 

A: Yes.  A third party lawsuit would be against someone who is not your employer or co-worker.  In this type of suit, you can pursue monetary damages for injuries or death that resulted from negligence.

You can also pursue an injury claim if your accident was the result of a defective product.  This claim would be made against the manufacturer.
