A seaman has filed a lawsuit against his employer for an alleged injury that occurred while the maritime worker was working aboard a tugboat. Lee Trevino filed the lawsuit in federal court in New Orleans on February 22, 2011. The suit was filed against D & S Marine Service.
The lawsuit states that Mr. Trevino sustained an injury while working as a tanker man aboard one of D & S Marine Service’s tugboats. The alleged incident took place on October 24, 2009. Mr. Trevino claims that he suffered a serious and permanent injury while performing duties as a seaman aboard the tugboat.
According to the suit, Mr. Trevino’s injury was a result of negligence on behalf of D & S Marine. The suit also alleges that the tugboat was unseaworthy. There was no information available concerning details of the tugboat accident and Mr. Trevino’s injuries.
Mr. Trevino is seeking more than $200 million in damages that include lost wages, loss of earning capacity, physical pain and suffering, mental anguish and medical expenses. He is also seeking damages for emotional distress, disfigurement, disability, loss of the ability to enjoy life’s pleasures, court costs and past and future maintenance and cure.
The case has been assigned to U.S. District Judge Eldon E. Fallon.
