Transocean trying to force medical exams on Deepwater Horizon survivors

Seven workers hurt in the Deepwater Horizon explosion are standing up against Transocean’s attempts to force them to take physical and mental exams.

On June 24, two of the company’s lawyers asked U.S. Magistrate Judge Sally Shushan to set appointments and obtain medical reports on the employees who have claimed orthopedic and emotional injuries.

The attorney for the workers is resisting Transocean’s efforts, challenging the constitutionality of the 160-year-old Limitation of Liability Act which caps the company’s liability to the value of the vessel.

So far, requests by Shushan  to submit to Transocean’s demands for examinations have been met by silence.

If you are an injured seaman and your employer tries to force you to an examination by a company doctor, see an experienced offshore attorney first to weigh your options. Under the Jones Act, you have a say in your medical treatment.
