A Beaumont, Texas man has filed a lawsuit against three companies after falling off a ladder and breaking his leg.
Charles Flores, Jr., filed the case Sept. 25 in Jefferson County District Court against BBC Chartering USA, H20 Production Systems and Boumans & Associates, the Southeast Texas Record reported.
The lawsuit was filed under the Longshore and Harbor Workers’ Compensation Act (LHWCA).
On Sept. 18, 2010, Flores was unloading a ship at the Port of Beaumont while under the employment of Shippers Stevedoring, his lawsuit states. As he climbed a ladder from the hold to the deck—even with two workers holding the ladder—it slipped and he was thrown down to the deck. His leg was broken and subsequently became infected, his lawsuit claims.
The defendants are accused of failure to provide a safe working place and failure to maintain the work area.
Flores seeks compensation for pain, impairment, mental anguish, disfigurement, lost wages and past and future medical expenses.
