Recently, I met with a maritime worker who fell victim to a standard trick that has come back to haunt him.
The worker was injured on the job, apparently due to company negligence. The company offered to pay for the worker's medical bills and gave him some money on top of that. The worker chose to sign a 15 page document, allegedly releasing any and all legal claims against the company.
The worker signed the papers without getting his own, independent legal advice.
Some time later, it turned out that the worker's medical condition was worse than he originally suspected (wonder if the company doctors told him that the injury may get worse?).
When the injured worker let the company know his injury was getting worse and not better, the company fired him.
The worker wanted to pursue a legal claim. Unfortunately, the worker has probably signed away his legal rights.
Lesson:
Just because the company treats you well immediately after you are injured doesn't mean the company will do the right thing after that. Be very careful signing any paperwork, especially if you are potentially signing away your legal rights forever, and especially if you don't have your own, independent legal advice on the meaning of what you are signing.
