In a recent report by the Washington Journal, seaman may collect for punitive damages after a maritime injury on the job, after the ruling in Atlantic Sounding Co. v. Townsend.
The ruling is allowing that seamen injured on the job may sue for punitive damages when employers refuse to pay for medical care and time off. Townsend was a tugboat crewmember when he was injured after falling on the boat's deck. The boat's owner, Atlantic Sounding Co., said it would not pay Townsend for medical care and time off.
