Seaman files Jones Act lawsuit against Transocean

A seaman is suing Safway Services and Transocean Offshoreusa Inc.

Carlos Gutierrez claims he suffered serious head, neck, back and right arm injuries on Jan. 6, 2011 while employed by Safway aboard the Transocean owned M/V Discoverer Deep Seas.

He asks for compensation for physical, mental and emotional pain and suffering, loss of wages and earning capacity, fringe benefits, maintenance and cure, medical expenses and interest.

The defendant is accused of negligence for failure to provide a reasonably safe place to work, creating and maintaining an unseaworthy vessel, failure to properly supervise and train the plaintiff, lack of minimum safety requirements and lack of adequate personnel or equipment for the job.

The case was filed in St. Charles (La.) Parish District Court on June 13, 2011 and was moved by the defendants to federal court in New Orleans on July 1, 2011.
