Seaman claims company’s lie responsible for his serious injuries

A Louisiana seafarer who fell while trying to remove a protector from a pipe is suing his employers, alleging they lied to him about the pipe’s condition.

Donald Rushing was a “borrowed seaman” on the BP Thunderhorse when he was ordered to remove the protector cap. Rushing alleges that the defendants informed him that each cap had a hole drilled in it to release pressure. That was not true, says Rushing, who claims that a burst of several hundreds of pounds of pressure caused him to fall, with equipment also falling on top of him.

Rushing claims injuries to his back, legs, hip and other areas of his body with severe pain and mental anguish. He is asking for unspecified monetary damages and a trial by jury.

The defendants are employers Pride International Inc. and BP Exploration & Production Inc.

The incident occurred February 4th and the case was filed April 12 in Galveston County, Texas.
