If you get hurt or victimized on a cruise, you only have one year to file a lawsuit. That’s because, lost in the fine print of the ticket, there is a clause allowing the passenger ship company to escape the normal three year maritime claim filing period.
67-year-old Elizabeth Reimer of Texas heeded the advice to act fast after breaking her leg when it was crushed between a tender boat and the pier in Grand Cayman Island while going ashore from the Carnival Conquest in April.
Her attorney filed a negligence claim. An employee told her that the leg was only bruised and all she needed to do was “walk it off.” In actuality, she had a fractured tibia which required the insertion of a metal plate and bolts. She spent the rest of the cruise in a wheel chair. The experience also gave her recurring nightmares, she said.
Carnival recently settled her claim for $125,000.
