New Jones Act Case Permits Punitive Damages When Company Fails to Pay Maintenance and Cure

The Eleventh Circuit Court of Appeals has ruled that punitive damages may be appropriate when a Jones Act employer wrongfully and intentionally refuses to pay maintenance and cure to an injured worker.

The case is Atlantic Sounding and Weeks Marine v. Townsend et al.
