Mariner alleges he was forced back to work while still out on medical treatment


A seaman has filed a lawsuit for allegedly being ordered to return to work while he was recovering from an existing shoulder injury.

Cooper Hayden filed suit May 20 in New Orleans federal court against Odyssea Marine Inc.

His complaint states that on July 30, 2010, he was told to get back to work despite the fact that he was receiving conservative treatment on the shoulder. Then, he was required to perform duties that aggravated the shoulder condition.

The defendant is charged with neglecting, refusing and withholding maintenance and cure.

Hayden seeks damages for pain and suffering, loss of earnings, mental anguish, fright, shock, humiliation, aggravation of a prior condition, maintenance, cure, court costs, interests, attorney’s fees and punitive damages.
