A commercial diver claims his right arm was seriously injured and disabled while conducting a dive in the Gulf of Mexico because he did not have the proper tools.
Dane Emmert Peterson’s lawsuit against Epic Diving & Marine Service was filed in New Orleans federal court, the Louisiana Record reports.
Case documents state that on Aug. 19, 2009, Emmert’s arm was caught in a subsurface structure as he assisted with removing component parts of the DB Southern Hercules, resulting in the injuries stated.
The defendant is accused of negligence for failure to operate, maintain and equip the DB Southern Hercules and failure to provide a safe workplace.
Peterson asks compensation for permanent injuries, post-traumatic stress, emotional distress, loss of wages and earning capacity, punitive damages, medical expenses and other damages.
