A Galveston County seaman has filed a
Jones Act lawsuit against his employer alleging that he was wrongfully terminated following a head injury. James Gowdy filed a Jones Act suit against Kinder Morgan Inc. on January 13, 2011 in Galveston County District Court and is seeking $5 million.
Mr. Gowdy claims that he sustained a head injury while working onboard the M/V Audrey on March 24, 2010. He is seeking $5 million from his employer claiming that he was wrongfully terminated by the company as a result of his maritime injury.
According to the petition, Mr. Gowdy and a co-worker were tightening a mechanical wench when the co-worker lost control of a stainless steel teeter bar. The teeter bar then struck Mr. Gowdy in the head, leaving him unconscious for approximately five hours.
Mr. Gowdy claims that he woke up in a Sulphur, LA hospital and was not able to recall the maritime accident. The suit alleges that he sustained a head injury, as well as injuries to his neck, legs and other parts of his body.
The seaman says that the injury left him unable to work and that his employer terminated his employment as a result.
Consequently, Mr. Gowdy is seeking a jury trial as well as $5 million in damages.
