Five key steps to take if you are injured at sea

All too often injured maritime workers hurt or completely ruin their injury case by doing or saying the wrong thing before they talk to a Jones Act attorney.  If you have been injured at sea, here are five very important things to keep in mind:

 

  1. Get medical care.  No matter how you were hurt, it is very important that you get the appropriate medical care as soon as possible.  If your vessel has a medic who can administer first aid or emergency care, you should see them.
  2. Report the accident.  If you are hurt while at sea, report the accident to your supervisor and fill out an accident report as thoroughly as possible.  Keep in mind that anything you say and anything you write on the report could be used against you later.
  3. Get pictures of the accident scene.  You should take pictures of the accident scene if possible, or get somebody else to do it.  Pictures can be very useful in your case.
  4. Be careful what you sign.  Don’t sign anything that you don’t completely understand and don’t sign an accident report unless it is complete and accurate.  Never sign blank documents or anything that looks like a release or waiver.  You do NOT have to sign anything before you get medical attention.  It is best to ask a lawyer about any documents that you are asked to sign.
  5. Keep a thorough record.  Keep a record of everything that happens, everything you sign, and anything you are told.
