Court Denies Hercules Offshore's Appeal of Injured Employee's Lawsuit

We are currently representing a long-time employee of Hercules Offshore who was injured twice.  The claim we've filed for him alleges that he was fired after the second injury, although Hercules claims he was simply part of a routine lay-off (or what they euphemistically call a "Reduction in Force."  As in when the employee gets home and his wife asked him what happened that day, he says "Honey, I got Reduced in Force.")

Our client filed his lawsuit in Galveston and Hercules then sued our client in Harris County.  Hercules tried to move our injured offshore client's lawsuit to Harris County.  The Galveston judge denied Hercules motion, then Hercules appealed that decision.

Last week, the Court of Appeals in Houston denied Hercules appeal.  Therefore, the injured Hercules employee (former employee) will get his day in Court in Galveston County where he originally filed his lawsuit.
