A Louisiana boat owner who lost a $3 million verdict is suing his former attorneys for negligence.
Heather Lynn Inc. claims the old firm did not assert the “Shipowner’s Right to Limitation of Liability” as a defense; the value of the M/V Captain Rayne, the vessel in questions, was approximately $300,000.
The boat was the subject of a civil lawsuit in 2008 in St. Mary Parish Civil District Court. The plaintiff was awarded $3 million. Since the defendant’s insurance policy was limited to $1 million, Heather Lynn was responsible for the remaining judgment.
The former attorneys are accused of negligence, breach of contract and breach of fiduciary duty.
The case was filed on June 27 in Orleans Parish Civil District Court.
